Abstract:
Legal obligation’s physician to obtain consent from the patient, before treatment, is a general rule and is one of the most visible signs of the principle of patient’s Autonomy.
One of the elements of consent is knowledge. This means that consent should be based on knowledge and legally valid consent is the consent based on necessary information and appropriate transfer of patient information and in this context, review of these cases is essential that what is the patient awareness role in reducing responsibility of the physician; is detailed knowledge always necessary or is there any cases in that brief knowledge be enough?
Also the quality of the patient’s awareness and its conditions and practices, have a direct and important impact on patient consent.
On the other hand, the general role of informed consent, has exceptions includes such items as Emergency Situations, Therapeutic Privilege and Waiver, make limits for informing to obtain consent of the patient, or essentially make it impossible to obtain an informed consent process.
In this regard, in the general conditions and exceptions, duties and responsibilities of the physician and the medical personnel can be investigated.
